I have a 2 1/2 yrs old son with a tica,Im from florida.I dont have my residency yet but working on it..I m court ordered to pay child support and my passport is blocked to leave the country unless I have her signed permission or put 13 months of child support in the bank (in her special account).I dont have to leave the country every 3 months because I have a costa rican son. But my question is can I get a job without my residency since I am court ordered to pay child support every month or I go to jail and I cant leave the country.I have tried to find this out for the longest time and like everything else in this country you can never get a straight answer or hear the same answer twice. Not even from a lawyer..If nobody on here knows where would be a good place to try..Ive been very unsuccessful at hearing the same answer twice if they even have an idea to start with.. Thanks for any help you can provide..

If you have a child here you are entitled to immeadiate permanent resedency that allows you work at any job, as you have family here. This type of residency is the fastest to recive. Pursue your residency. It may mean having a paternity test, but if you already subject to court order child support, than I would assume the paternity issue has been resolved. So get your residency and start working.

2BNCR… you forgot to finish your sentence…. “So get your residency and start working… for $3.00 per hour!” A tough way to make a living and get residency if you ask me. It would seem that if this poor fellow is already court ordered to pay child support the issue of paternity has already been addressed. And the fact that he’s paying child support (doing the right thing) in the first place means the relationship with the mother is over. And now he’s a prisoner in CR, unable to leave, getting “visits” from the local police and facing the fact that it will be very difficult to find a job that pays a “gringo” living wage that provides a decent standard of living while supporting his baby’s momma. Welcome to paradise!

YES he is a prisoner of the system and he will not see Florida again in a long time besides HE has to make his payments for child support.

He does not have a permanebt residency, he has a CAGE from he will not escape.

    Paradise??

    I don’t think so.

Well you guys, should he not support his child? Also, if he really wanted to leave CR, he could. Nicas do it all the time.

I agree that it seems to be a catch 22 about how he is supposed to make enough money to pay the child support, but Costa Ricans are faced with the same delima daily. Maybe this is a good lesson to those who are here regarding keeping their pants buttoned or a promo item for visectomies.

Agreed… no glove… no love! I respect the guy for trying to do the right thing… but I’m guessing this isn’t the life he had planned in paradise! I know if the guy wanted to “escape” and dodge his responsibilties he could…

Let this story be a reminder to everyone… the place is beatiful… as are the ladies… but be smart!

“I dont have to leave the country every 3 months because I have a costa rican son”

this is not quite true, as long as you do not have Residency you HAVE TO leave the country after 3 months, no matter you having a child or not, and you are not allowed to work until you have your residency in hands.
In your case, you CAN’t leave the country because of the Court order.
You need to decide what you want to do, stay in Costa Rica, get residency and try to find a job, even being paid as a Tico. OR deposit the 13 months of child support, go back home to Florida, and support your child from the U.S. if you are a responsable Dad.

Since your son is already 2 1/2 yrs old, you ‘should’ have already had your permanent residency, based on a first-degree relative status, as it is the easiest method, by now.
If, you proceeded immediately, that is, once he was born or even before. How long have you actually resided here?
Did you ‘work’ prior to having a child or are you independently ‘wealthy’?
Or, dare I ask, can afford to deposit the 13 months alimony, but choose not to?

I’M working on my residency all I got left to do is bring it to immigration.I’ve been living in costa on and off since 2004. I worked at a sportsbook that my friend owns in alajuela but i never had a work permit. I dont work there anymore the guys running the office I dont get along with.I could put the 13 months in the bank but I dont trust her enough to do that, I know she would spend it in 2 days and my son wouldnt see any of it. and then she’d be broke for the rest of the year and my son would lose out..So I pay her once a month..But my question is shouldnt they give me a work permit if they have ordered me to pay support even if I dont have residency? They tell me I have to pay so I think they should give me the means to do so…even without residency, dont you think? But this is costa rica were talking about, doing that would make to much sense and that is very rare here..

My lawyer here told me I dont have to leave every 3 months because its my constitutional right to stay here as long as I want since I have a son here..Its an exception to that rule. beside the country wont let me leave so they cant penalize me for not leaving, there the ones telling me I cant. But who knows in this assbackward country!!!!

I’m glad you’re trying to ‘do the right thing’. And agree that you are in a ‘catch 22’ situation.

Kidd After you slipped out over the Southern border once why did you come back to a country you don’t like with no job and an obligation you have trouble meeting? It would be easier to use MoneyGram from the US to send the child support.
